หลายคนในประเทศไทยและในต่างประเทศตั้งคำถามว่าประเทศไทยมีคณะกรรมการสิทธิมนุษยชนหรือไม่ และถ้ามี...คณะกรรมการนี้กำลังทำอะไรในสถานการณ์ที่รัฐบาลประชาธิปัตย์และทหารใช้กฎหมายหมิ่นพระบรมเดชานุภาพในการทำลายสิทธิเสรีภาพและประชาธิปไตยอย่างถ้วนหน้า....
ในคืนวันที่ 27 มกราคม 2552 ผมได้คำตอบจากประธานคณะกรรมสิทธิมนุษยชนแห่งชาติ ศ.เสนห่ จามริก ซึ่งแจ้งให้ผมทราบว่าคณะกรรมการฯ “รับทุกเรื่อง...แต่บางเรื่องคงต้องใช้เวลานาน” ต่อคำถามว่าทำไมกรณีที่คณะกรรมการฯออกแถลงการณ์โจมตีตำรวจ กรณี 7 ตุลาคม 51 ออกมาได้เร็ว ศ.เสนห์ ไม่มีคำตอบ ต่อคำถามว่าตอนนี้มีคนติดคุกที่ศาลไม่ให้ประกันตัวทั้งๆที่ยังไม่มีการพิพากษาว่าผิดในคดีหมิ่นพระบรมเดชานุภาพ ศ.เสนห์ จามริก ก็ไม่มีคำตอบเช่นกัน เมื่อผมถามอาจารย์เสนห่ว่า ที่ผมเขียนจดหมายถึงอาจารย์โดยตรงเรื่องคดีผม อาจารย์อ่านหรือไม่ อาจารย์เสนห่ ตอบว่าไม่ได้อ่าน
ประชาชนชาวไทยมีสิทธิที่จะตั้งคำถามว่าเรามีคณะกรรมการสิทธิมนุยชนแห่งชาติไปทำไม เพราะกรรมการสิทธิชุดปัจจุบันดูเหมือนไม่อิสระจากอำมาตยาธิปไตย เข้าข้างพันธมิตรฯ และไม่สนใจปกป้องสิทธิเสรีภาพในการแสดงออกซึ่งเป็นหลักพื้นฐานของประชาธิปไตยสากล
Many people in Thailand and abroad are asking the question: “Is there a National Human Rights Commission in Thailand? And if so, what is it doing about lese majeste?”

Well, the answer is simple. Nothing. Prof Senay Jarmrick, Chairman of the Thai Human Rights Commission, says “it all takes time”. Other commissioners say “there is a process to follow”. But a number of people are sitting in prison, without bail, before they have even been tried, I stated. No answer. The Human Rights Commission has been totally silent about all lese majeste cases for over a year, despite all these cases being gross abuses of human rights and freedom of speech. In contrast, the commission quickly came out with a statement supporting the PAD demonstrators who clashed with the police on 7th October 2008. Apparently, the process, in that case, was quick and easy.

Amnesty International are not much different. When asked if they would take up lese majeste cases, the initial answer was ... “this is sensitive, if we take up the cases we might be refused visas to Thailand”. Well, there you have it. If you were paying money to AI, you might consider switching to some other human rights organisation.
